Dimopoulos Realty Trust of Burlington has been assessed a $5,000 penalty from the Massachusetts Department of Environmental Protection (MassDEP) for violations of environmental cleanup requirements at Jimmy’s Garage, located at 170 Main St. in Maynard.

MassDEP was notified of a gasoline and diesel release from underground storage tanks at Jimmy’s Garage in June 2003, according to a statement. At the time of the release, MassDEP required soil excavation and operation of an underground oxygen injection system to accelerate the breakdown of petroleum in groundwater. In March 2010, MassDEP found that the injection system had been shut down, and that reports had not been submitted notifying MassDEP of the system’s deactivation, a violation of cleanup regulations.

"Cleanup of sites is the responsibility of property owners and operators," said Mary Gardner, deputy director of MassDEP’s central regional office in Worcester. "Failing to take action and provide reports to document the cleanup are serious violations."

Dimopoulos Realty Trust must also submit either a full assessment and cleanup plan, or a site closure report that indicates that the site has been cleaned up and closed out by February.
