The Massachusetts Land Court has dismissed a zoning challenge to John Rosenthal’s 1.3 million-square-foot Fenway Center, the $450 million development he plans to build above the Massachusetts Turnpike near Kenmore Square, according to reports.
The court tossed out a challenge filed by HRPT Medical Buildings Realty Trust, a project neighbor. The trust’s executives thought the project should be stopped because city regulators did not acknowledge what the trust considered an infringement on its property by the project. That zoning challenge has kept the project from getting shovels in the ground for the last three years.
Land Court Judge Harry Grossman disagreed, ruling that the Boston Zoning Commission’s 2009 approval of the project was, in fact, valid and the project would not harm HRPT and the public, as HRPT claimed.
