A Marlborough realty trust has been fined $10,000 by the state Department of Environmental Protection (MassDEP) for violating site cleanup requirements at one of its properties.

K5 Realty Trust LLC was ordered to pay the fine for violating cleanup requirements at property owned by the trust at 257-267 Maple St. in Marlborough.

A November 2008 inspection at the property found soil management procedures were not being followed. MassDEP identified additional violations regarding the trust’s failure to submit reports within the required time frames.

MassDEP worked with the contractor to correct the soil management procedures, prevent worker exposures, and ensure that the trust submits all required documentation in compliance with the regulations.

The trust must pay the $10,000 penalty, submit an amendment to include a description of the changes in site usage and submit a revised site closure statement once the cleanup is completed.

"It is important that site conditions be completely understood before construction begins," said Mary Gardner, deputy director of MassDEP’s central regional office in Worcester. "Soil management procedures are required at some sites with residual contamination that must be followed to avoid unacceptable exposures and risks to public health."
