Attorney General Martha Coakley’s Office has issued citations against three construction companies which performed work at several sites developed by Virginia-based AvalonBay Communities, Inc. which has offices in Massachusetts.

The Attorney General’s Office has also reached settlement agreements with two other construction companies that also performed work at AvalonBay sites.

The construction companies violated the Massachusetts independent contractor/misclassification law and the Massachusetts wage and hour laws.  

Beginning in February 2007, the Attorney General’s Office received numerous complaints claiming that workers were being misclassified as independent contractors on various AvalonBay construction projects throughout Massachusetts. After investigations and audits of the records, violations of the Massachusetts wage and hour laws were revealed. 

Settlements have been reached with DaVinci Construction Co. of Massachusetts and AMC Building Construction of Rochester. DaVinci agreed to a compliance plan and AMC will pay a $10,000 penalty.

C & K Sub-Contractors of Fairfax, Va. was cited $5,000,; F.A. Construction of Revere was cited more than $11,000, and National Carpentry Contractors, based in Connecticut and Tennessee, was cited more than $15,000.
