The Massachusetts Department of Environmental Protection (MassDEP) has fined Getty Properties Corp. $3,000 for their failure to submit monitoring reports within required timelines for a remediation site in Monson. The site is a gasoline station located at 27 Palmer Road in Monson.

In July, 1999, MassDEP was notified by Getty that gasoline and the chemical methyl tertiary-butyl ether (MTBE) had been discovered in the groundwater in an on-site groundwater monitoring well. Getty later completed assessment of the soil and groundwater and determined that site cleanup actions were required. The company selected a remedial system designed to extract petroleum vapors from soil and groundwater in order to achieve the required cleanup. Operation of the remedial system began on September 15, 2008 and has continued remedial operations since then.

Regulation requires submittal of remedial operation monitoring reports every six months. MassDEP found that since Nov. 12, 2008, Getty has failed to submit two required reports and that three reports were submitted late. Failure to submit reports as required or to submit reports in a timely fashion are violations of MassDEP regulations. Getty continued a pattern of late or missing submittals even after MassDEP issued a Notice of Noncompliance to Getty on Jan. 4, 2012.
