A Southborough construction company faces more than $80,000 in restitution and penalties for violating the state overtime law, Attorney General Maura Healey announced today.
JBJ Construction LLC, and its owner, William Depietri, of Southborough, were cited $83,965.53 in restitution and penalties for failing to pay overtime to 28 employees.
The AG’s office began an investigation receiving a complaint from a JBJ Construction employee alleging that he worked over 40 hours in a week but was paid the regular rate of pay. The investigation revealed that between September 2012 and October 2014, the company did not pay overtime wages to 28 of its employees. The state’s overtime law requires employers to pay qualifying employees time-and-a-half of their regular rate of pay for all hours worked over 40 in a work week.
“When companies do not pay overtime, they are cheating workers and gaining an unfair advantage over honest employers,” Healey said in a statement. “We will continue to pursue companies that violate these laws that are intended to protect workers and ensure they receive their hard-earned wages.”
